Sounds like this will end up in court . Problem is if it were to be overturned How would that work? They would have to give the first place to Maximum Security but what about all those that had tickets on it? What about the ones that had tickets on the one declared the winner. I don't think it right the racing commission would not over turn it if there is undeniable proof the call was wrong. But what could be done about it?

New Video Raises Questions In Kentucky Derby Disqualification
A video released by an attorney for a Kentucky Derby jockey raises new issues about the controversial disqualification of Maximum Security as the winner of the big race.
Maximum Security crossed the finish line first May 3, but was disqualified after race officials determined that he had impeded the path of other horses as he appeared to swerve right from the rail.
A carefully annotated video (above) provided to racing officials by an attorney for Maximum Security's jockey Luis Saez, however, appears to show War of Will crowding Maximum Security, which may have forced Maximum Security to change lanes.
A written commentary with the video claims that War moved too soon into an "anticipated opening" near Maximum Security. War of Will may have even clipped Maximum Security with his hooves or legs, forcing the frontrunner to "jump out of the way," and causing a veering domino effect, the video commentary argued.
It was the first time in history that a winner has been disqualified in the Kentucky because of a foul.
Gary and Mary West, owners of Maximum Security, believe the newly released video exonerates their horse, reported the Louisville Courier Journal.
Attorney Karen Murphy told the newspaper Saturday that the video is "indisputable" and "gives a full picture of what happened." She added that there is "no doubt" that War of Will started the interference.
"Maximum Security did absolutely nothing wrong," Murphy said. "All he did was protect himself."
The Wests appealed the race ruling Monday, but the Kentucky Horse Racing Commission denied their request, stating that racing stewards' decision about race events are "final and not subject to appeal." Gary West has said he will file a lawsuit regarding the decision against his horse, who was the only undefeated horse in the field of the Derby when the race began.
War of Will's owner could not immediately be reached for comment. The racing commission has not responded to the video.
Maximum Security was dropped down to 17th place in a field of 19 horses after racing officials ruled that the horse interfered with the progress of War of Will, who in turn interfered with Long Range Toddy and Bodexpress.
Country House, a 65-1 longshot who finished second, was then deemed the official winner of the 145th Kentucky Derby about 20 minutes after the end of the race.
Country House was the second-longest shot to ever win the Derby. Code of Honor officially finished second, and Tacitus moved up to third place.
The winner took home an estimated $1.86 million.

The stewards from the Kentucky Horse Racing Commission met Friday for the group's routine post-event hearing that will continue the most controversial week the Kentucky Derby has ever seen.
They met with the jockeys involved in the inquiry of the 145th derby that saw Maximum Security disqualified and Country Horse named the winner. Lawyers provided video alleging War of Will and jockey Tyler Gaffalione were at fault, not Maximum Security.
Saez secures lawyer ahead of meeting
Luis Saez, Maximum Security's jockey, has already hired an attorney for his defense should the commission discipline him. Ann Oldfather is a well-known Louisville trial lawyer who gained recognition as a divorce lawyer and civil litigator. Oldfather won millions in back pay for firefighters and won a verdict against McDonald's, according to the Louisville Courier-Journal.
Saez was compared to a "drunk driver" by War of Will trainer Mark Casse days after the race.. War of Will was caught in the group of horses behind Maximum Security. Oldfather called the accusation baseless and said it was a "flawless ride" under "great duress."
Gary and Mary West, owners of Maximum Security, are still evaluating their legal options as of Thursday and insist their horse was the best that day. Their appeal with the KHRC was denied Monday, the same day they filed it.
Lawyers: Video shows War of Will at fault
Oldfather provided a video, shared with the Louisville Courier-Journal, that shows an alternate perspective. It defends Saez from "foul riding" and alleges War of Will and Casse made an early move into a closed lane and caused the issue.
It starts with War of Will being pushed out of the gate to get positioning, then highlights what lawyers say is Gaffalione fighting to restrain War of Will around the corner. The video pauses to highlight language used by announcers and a since deleted tweet by Gaffalione about "anticipating a spot"
That moment is when lawyers allege a "domino effect" occurred with Maximum Security already in the lead and his own lane. It goes on to allege Maximum Security stayed in the horse's own lane and continued to be struck by War of Will from behind while the jockey does nothing to restrain the horse.
"Following the meeting, stewards typically deliberate," Churchill Downs spokesman Darren Rogers said, per the Courier-Journal. "If any suspension or fine is assessed, it's typically announced on the KHRC website within a 24-hour period."
