'He did not invent the casting couch': Harvey Weinstein's lawyer offers up surprising defense to rape charges as handcuffed mogul posts $1M cash bail and agrees to wear GPS bracelet

Harvey Weinstein was all smiles as he was charged with multiple counts of rape in a New York courtroom on Friday.

The 66-year-old disgraced movie mogul was arrested, processed and booked for the alleged sexual assault of two women shortly after 7:30am, arriving alone in a chauffeured SUV before being taken in to the station by two members of the special victims unit - Detective Nicholas DiGuadio and Sergeant Keri Thompson.
He then headed off with his hands cuffed - in three linked handcuffs on account of his girth - to criminal court, where he was paraded around in front of spectators and looked to be in a daze, exclaiming at one point: 'Wow.' 
Weinstein's attorney Benjamin Brafman met him in court, holding his client's passport for all to see before surrendering it to the judge as part of his bail.
He also handed over a cashier's check to cover the $1 million cash bond before leaving the court, with Weinstein heading off alone to be fitted for his electronic monitoring bracelet.
Weinstein was ordered to remain in New York or Connecticut as he prepares to face trial, and Brafman said outside court that Weinstein will enter a plea of not guilty. 
Brafman then spoke outside court, and offered up an unexpected defense for his client. 
'My job is not to defend behavior. My job is to defend something that is criminal behavior,' stated Brafma.
'Mr. Weinstein did not invent the casting couch in Hollywood. To the extent that there's bad behavior in that industry, that is not what this is about. Bad behavior is not on trial in this case.'

'Deponent states that he is informed by a person known to the District Attorney's Office that on one occasion between June and September of 2004, in the daytime hours, inside of 375 Greenwich Street in the County and State of New York, defendant forced informant to engage in oral sexual conduct, to wit, defendant grabbed the back of informant's head forcing her head downward and forcing her mouth onto his penis,' reads the criminal complaint. 

HARVEY WEINSTEIN FACING UP TO 54 YEARS IN PRISON ON CHARGES

Rape In the First Degree (Class B Felony) - Five to 25 years in prison and a fine of up to $5,000 
A person is guilty of rape in the first degree when he or she engages
in sexual intercourse with another person:
1. By forcible compulsion; or
2. Who is incapable of consent by reason of being physically helpless; or
3. Who is less than eleven years old; or
4. Who is less than thirteen years old and the actor is eighteen years old or more.
Rape In the Third Degree (Class E Felony) -  Up to four years in prison and a $5,000 fine
A person is guilty of rape in the third degree when:
1. He or she engages in sexual intercourse with another person who is incapable of consent by reason of some factor other than being less than seventeen years old;
2. Being twenty-one years old or more, he or she engages in sexual intercourse with another person less than seventeen years old; or
3. He or she engages in sexual intercourse with another person without such person`s consent where such lack of consent is by reason of some factor other than incapacity to consent.
Criminal Sexual Act in the First Degree (Class B Felony) - Up to 25 years in prison 
A person is guilty of criminal sexual act in the first degree when he or she engages in oral sexual conduct or anal sexual conduct with another person:
1. By forcible compulsion; or
2. Who is incapable of consent by reason of being physically helpless;or
3. Who is less than eleven years old; or
4. Who is less than thirteen years old and the actor is eighteen years old or more.
 

'Deponent further states that he is informed by a second person known to the District Attorney's Office that on March 18, 2013, in the morning hours at 569 Lexington Avenue, in the County and State of New York, defendant kept informant physically against her will in a room and engaged in sexual intercourse with informant by forcible compulsion, to wit, defendant penetrated informant's vagina with his penis and, at the time of the incident informant had clearly expressed her lack of consent to the act.'
In court, the prosecution outlined its case thus far to the judge.
'Your honor, the defendant is before the court charged with two violent B felonies for two separate violent sexual assaults against two women,' said prosecutor Joan Illuzzi, who previously led the trial of Dominique Strauss-Kahn. 
The charges here today are the result of months of investigations. The defendant used his position, money and power into positions where he was able to violate them sexually. We encourage others to come forward.'
Outside court his lawyer stated: 'I anticipate that the women who have made these allegations, when subjected to cross-examination ... in the event we get that far ... will not be believed by 12 people.'
He then included a caveat, adding: 'Assuming we get 12 fair people who are not consumed by the movement that seems to have overtaken this case.'
The investigation is ongoing however, and a grand jury is still convened and hearing testimony in the case.
Weinstein will now have the option of testifying in front of that jury should he wish as the men and women now into possible financial fraud and is he worked with members of his staff to identify potential victims.
One of the women accusing Weinstein, Lucia Evans, claimed that she was forced to perform oral sex on him at the then-Miramax offices in Tribeca.
The second woman worked with Weinstein when she claims he forced himself on her at the DoubleTree Hilton in Manhattan. 
Evans confirmed the fact that she was one of the woman who helped bring charges against Weinstein in an interview with The New Yorker on Thursday, saying: 'At a certain point, you have to think about the greater good of humanity, of womankind.' 
'Today, at the NYPD's 1st Precinct, Harvey Weinstein was arrested, processed and charged with rape, criminal sex act, sex abuse and sexual misconduct for incidents involving two separate women,' said the NYPD in a statement on Friday morning. 
'The NYPD thanks these brave survivors for their courage to come forward and seek justice. The arrest and ensuing charges are the result of a joint investigation between the NYPD and the Manhattan District Attorney's Office. Additional information will be provided as it becomes available.' 
Cyrus Vance also released a statement, saying: '"Today's charges reflect significant progress in this active, ongoing investigation.
'I thank the brave survivors who have come forward, and my Office's prosecutors who have worked tirelessly on this investigation. I would also like to thank Commissioner James O'Neill and our dedicated partners at the NYPD.'
Weinstein seemed carefree in photos taken by DailyMail.com as he strolled into the police precinct in Tribeca, just a few blocks from his old office.
He carried a copy of the Rodgers & Hammerstein biography, Something Wonderful, as well as a book about the life of Elia Kazan.
Kazan, who was once one of the most celebrated directors in Hollywood, also had an epic fall from grace when he exposed communists in Hollywood during his 1952 testimony in front of the House Committee on Un-American Activities.
Weinstein did not have the books on him when he was led out of the station in handcuffs on Friday..
The books were returned to his possession however once he left court. 
The news of Weinstein's arrest comes amidst growing backlash against Manhattan District Attorney Cyrus Vance for refusing to charge the 66-year-old.   
In the state of New York there is no statute of limitations on rape, criminal sexual act or aggravated sexual abuse in the first degree, due to a bill signed in 2006 eliminating the previous five-year statute. 
Federal prosecutors have also officially begun their probe into Weinstein, a source told DailyMail.com on Thursday. 
Evans was one of the first women to come forward and reveal misconduct by Weinstein, alleging r that he had forced her to perform oral sex on him in 2004 at his office.
Evans [nee Stoller] was preparing for her senior year at Middlebury in 2004 when she met Weinstein at Cipriani in New York City.
She wanted to be an actress and gave the executive her phone number, eventually agreeing to come in and read for a female casting director at Weinstein's offices in Tribeca.
When she arrived however she was taken to meet Weinstein in a room with empty takeout boxes and exercise equipment.
The two spoke for a bit and then, according to Evans, Weinstein pulled out his penis and forced her to perform oral sex on him inside the office.
'I said, over and over, "I don't want to do this, stop, don't,"' said Evans.
'I tried to get away, but maybe I didn't try hard enough. I didn't want to kick him or fight him.' 
Weinstein's size ultimately proved to be too much for Evans she claims, saying she eventually found herself completely helpless.
'I just sort of gave up. That's the most horrible part of it, and that's why he's been able to do this for so long to so many women: people give up, and then they feel like it's their fault,' said Evans.
Weinstein later acted as if nothing had happened she said, and began calling her at night to meet.
Evans said she repeatedly turned down the executive.
The repercussions from the incident last to this day however, with Evans saying she still had nightmares.
'I had an eating problem for years. I was disgusted with myself. It's funny, all these unrelated things I did to hurt myself because of this one thing,' said Evans.
'I ruined several really good relationships because of this. My schoolwork definitely suffered, and my roommates told me to go to a therapist because they thought I was going to kill myself.'
Weinstein assembled a two-person legal team to defend himself against the claims made by Evans and others last year.
'We do not believe an indictment of Mr. Weinstein is imminent. A formal presentation will be made on Mr. Weinstein's behalf in the appropriate course of the investigation, and we strongly believe we will demonstrate that no criminal charges are warranted,' said his spokesperson at the time.
It was then noted that Blair Berk and Ben Brafman 'will be defending Mr. Weinstein in any matters in New York.'
Berk has previously defended celebrities including Lindsay Lohan, Mel Gibson and Darren Sharper, who was sentenced to 20 years in prison in 2016 after pleading guilty to drugging and raping three women.
Brafman recently represented Martin Shkreli and previously served as an attorney for for the late Michael Jackson.  
The New York Times revealed in October that Weinstein surrounded himself with a very connected team of litigators before learning that charges would not be pursued in the case.
He retained Elkan Abramowitz, a former law partner of Vance, and Daniel S. Connolly, who was also a former prosecutor.
Linda Fairstein came on as a consultant and introduced Weinstein's lawyer Abramowitz to Martha Bashford, the head of the district attorney's sex crimes bureau.
This all came togther after the allegations made by Paz de la Huerta, who for some time seemed to the be the one who allegations would result in charges against Weinstein. 
'We have an actual case here, so we're happy with where the investigation is right now,' said Chief Boyce back in early November in a rare public comment on an ongoing investigation.
'Mr Weinstein is out of state we would need an arrest warrant, to arrest him. So right now we're gathering our evidence and we continue to do so, every day. So that's where we are in the case.'
Chief Boyce revealed during the conference that subpoenas have been issued, before adding: 'If this person was still in New York and it was recent we would go right away and make the arrest, no doubt. But we're talking about a seven-year-old case. And we have to move forward gathering evidence.
Chief Boyce also made it very clear that de la Huerta was a strong witness, noting her 'ability to articulate each and every movement of the crime, where she was, where they met, where this happened and what he did. 


The case was further bolstered because De la Huerta was the first victim who was allegedly assaulted by Weinstein after 2006, when New York did away with the statute of limitations in instances of rape, criminal sexual act or aggravated sexual abuse in the first degree.
The assaults alleged by the other two women took place before that law was changed, which means that even if the district attorney's office files charges against Weinstein in those cases they could be tossed out of court by a judge.
Chief Boyce seemed to suggest that those probes have been put on hold while the focus turns to de la Huerta's allegations.
At the same time, the Manhattan District Attorney's office announced that they had assigned a senior sex crimes prosecutor to work on the case.
'As to others, I'm not going to close the door and say others wont come forward, but this is what we have right now, this is what we're moving forward with,' said Chief Boyce.   
Weinstein's booking in Tribeca comes almost three years to the day that he was almost cuffed and thrown in jail by NYPD at the same precinct..
It was back in 2015 when the NYPD set up a sting operation with model Ambta Battilana after she accused him of groping her during a business meeting.
She had agreed to record her conversation with Weinstein on March 28, 2015 when the two met at the Tribeca Grand Hotel, one day after she accused the movie mogul of groping her breasts and sticking his hand under her skirt.
The audio recording of the sting, which was obtained and published by the New Yorker last Tuesday, captured Weinstein apologizing to Battilana and telling the model: 'Listen, come up to my room.'
Detectives were on the scene at the time hoping to catch Weinstein in the act so that they might be able to arrest him on the spot.
At the last second, however, Battilana could not go through with it out of safety fears and the pair returned downstairs, where Weinstein was soon picked up by the detectives and taken in for questioning. 
Battilana is one of the eight women who allegedly received a settlement from Weinstein according to the explosive New York Times investigation that was released on Thursday.
Weinstein first met Battilana at a show he was producing in New York on March 2015. The film mogul introduced himself to her and repeatedly stated that she looked like Mila Kunis, according to an expose by the New Yorker.
He scheduled a meeting at his Tribeca office with her the following day through her agency. She was sitting on the couch when he started staring at her breasts and then asked if they were real.
Battilana told NYPD officers that soon after, Weinstein lunged at her and groped her breasts and tried to put his hand under her skirt. She said he eventually backed off and then invited her to the Broadway play Finding Neverland with him the following night.
The Italian model never showed up at the play because she went to file a police report at an NYPD precinct regarding the alleged abuse. With the help of undercover officers, Battilana arranged to meet Weinstein again at the Tribeca Grand Hotel (now the Roxy).
She wore a wire to record her conversation with Weinstein during which he spoke of the actresses he had helped with their careers and offered to get her a dialect coach.
Weinstein was caught on the recording asking Battilana to come up to his hotel room and watch him shower.
She protested at first but then agreed to go upstairs. However, at the last minute, Battilana changed her mind and begged him to let her leave.
'I don't want to,' 'I want to leave,' and 'I want to go downstairs,' she says in the audio.
When she asked him why he groped her breasts, Weinstein responds: 'Oh, please, I'm sorry, just come on in. I'm used to that. Come on. Please... I won't do it again..'
Earlier in the recording he could be heard telling her: 'I'm telling you right now, get in here. I'm going to take a shower, you sit there and have a drink.
'I'm not doing anything with you, I promise,' he said before adding 'Now you are embarrassing me' as she protested in the hall.
Battilana said: 'No yesterday was kind of aggressive for me.'
Weinstein responded: 'Don't embarrass me in the hotel, I'm here all the time.
'I'm not going to do anything and you'll never see me again after this. If you embarrass me in this hotel where I'm staying at...
'Honey don't have a fight with me in the hallway. Please, I'm not going to do anything, I swear on my children. Please come in. On everything, I'm a famous guy.
'I will never do another thing to you. Don't ruin your friendship with me for five minutes. Please you're making a big scene.'
After going back and forth for two minutes, Weinstein agreed to let her go.
Charges were ultimately never filed against Weinstein after details about Battilana's past began to appear in the tabloid media, including that she had once attended one of the infamous Bunga Bunga parties thrown by former Italian Prime Minister Silvio Berlusconi.
Three days after meeting with Battilana at their office, a spokesperson for Vance announced that the probe into the incident did not find enough evidence to pursue a case.
'This case was taken seriously from the outset, with a thorough investigation conducted by our sex crimes unit,' said Joan Vollero at the time.
'After analyzing the available evidence, including multiple interviews with both parties, a criminal charge is not supported.' 
He may have turned himself in on serious charges of sexual misconduct, but Harvey Weinstein appeared to be planning to do a spot of reading while in the police station.
The disgraced producer was spotted walking into the Manhattan police station with two books under his arm; Elia Kazan: A Biography, about the influential film and theater director from the late forties through the sixties, and Something Wonderful: Rodgers and Hammerstein's Broadway Revolution..
He held a third book under his arm, in black leather binding, which could be a journal.


Kazan, who was once one of the most celebrated directors in Hollywood, also had an epic fall from grace when he exposed communists in Hollywood during his 1952 testimony in front of the House Committee on Un-American Activities. 
Kazan's achievements include the original Broadway productions of The Skin of Our Teeth, All My Sons, and Death of a Salesman.He also directed Hollywood classics such as Gentleman's Agreement, Brando's Streetcar, and Splendor in the Grass.
Weinstein has a habit of carrying whatever he happens to be reading under his arm, whether it be a newspaper, book or file so it's not unusual for him to show off his reading list.

An hour later, he emerged, sans books, handcuffed and flanked by police officers.
Many were young, powerless and afraid to speak out in case their careers were ruined.
For nearly three decades their accusations remained bottled up, some suppressed by pay-offs.
Dozens of women have now come forward with allegations of sexual harassment against Hollywood producer Harvey Weinstein, the man once described as 'God' of the film industry.
The accusations, including from some of the world's most famous actresses, range from inappropriate massages to rape.
